Resumen
La Ley Fundamental de Guinea Ecuatorial prevé, con carácter facultativo, que el Presidente de la República designe un Primer Ministro encargado de la coordinación administrativa y la articulación del Ejecutivo ante el Parlamento. Esta previsión, en un marco constitucional que concentra la jefatura del Estado y del Gobierno en el Presidente, ha suscitado interpretaciones que apuntan a una aproximación al semipresidencialismo. El presente artículo sostiene que tales lecturas descansan en un doble error: metodológico, por identificar la forma de gobierno desde la denominación de los órganos y no desde la distribución funcional del poder; e histórico, por aplicar al texto vigente las categorías del diseño constitucional previo, en el que el Primer Ministro era efectivamente jefe del Gobierno. Mediante el análisis sistemático de la Ley Fundamental de 2012 y de la Ley 2/2015, y la aplicación de categorías del Derecho Administrativo (competencia, delegación e imputación), se concluye que el Primer Ministro se configura como órgano de coordinación funcional subordinado a la dirección presidencial, sin titularidad autónoma sobre la función gubernamental. Se identifican además tres prácticas institucionales que alimentan el equívoco y se formulan recomendaciones de técnica jurídica para su corrección.
Abstract:
The Fundamental Law of Equatorial Guinea provides, on a discretionary basis, that the President of the Republic may appoint a Prime Minister to handle administrative coordination and parliamentary liaison. In a constitutional framework that concentrates the Head of State and the Head of Government in the President, this provision has generated interpretations pointing toward a semi-presidential model. This article argues that such readings rest on a double error: methodological, for identifying the form of government from the names of its institutions rather than from the functional distribution of power; and historical, for applying to the current text the categories of the prior constitutional design, in which the Prime Minister was indeed Head of Government. Through systematic analysis of the 2012 Fundamental Law and Law 2/2015, combined with administrative law categories (competence, delegation and imputation), the paper concludes that the Prime Minister operates as a functional coordination body subordinated to presidential direction, without autonomous title over governmental leadership. Three institutional practices that fuel the interpretive confusion are identified, and legal technique recommendations for their correction are advanced.
